1. Introduction

We, N-SIDE (hereinafter also referred to as “N-SIDE”, “our” or “us”) are a company incorporated under Belgium law, whose registered office is at Courbevoie 13, 1348 Louvain-La-Neuve, Belgium, registered with the Crossroads Bank of Enterprises (RPM Brabant-Wallon) under number 0472.607.061.  The term “N-SIDE” also includes any of our affiliates.

We are committed to protecting your privacy as a user of this website (“you”, “your”, “yourself”), as well as when you view our blogs, visit our premises, participate in our webinars and when you make use of our online services (“Website”).

Personal Data” refers to any information that relates to an identified or identifiable living individual, in the meaning of the Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) (the “GDPR”).

2. About this Notice

  1. This Privacy Notice (“Notice“) explains how we collect, share and use any Personal Data that relates to you when you use our website or otherwise are in a relationship with us (eventually through the company that employs you). We may also gather information and data on you through the Website when you make use of our services, when you send us e-mails, when you register for or attend any events which we host/promote, or when you interact with our representatives.
  2. This Notice also sets out the rights that you have in relation to the Personal Data that we process about you and how you can exercise them.
  3. For the purposes of this Notice, N-SIDE acts as the data controller for the Personal Data that is collected via the Website, since we determine the purposes and means of the processing of your Personal Data. As a data controller, N-SIDE is responsible for ensuring that the processing of Personal Data complies with applicable data protection law, and specifically with the GDPR.
  4. This Privacy Notice is written in such a way that it refers to a uniform minimum standard for the protection of personal data which is applicable to the whole N-SIDE group of companies (including N-SIDE LLC & N-SIDE KK). The principles outlined in the Notice will be applied within the group of companies, except if other compulsory data protection legislation is applicable which contains stricter obligations and conditions.
  5. N-SIDE may also process your personal data in very limited cases as “data processor”, notably in your use of the N-SIDE platforms. In such cases, terms of data processing as concluded between your employer and N-SIDE shall apply, in compliance with the applicable data protection legislation.

3. What Personal Data does N-SIDE collect and why?

Marketing communication, documentation, training
For newsletter subscriptions, event registrations, webinars, gated content downloads  or login features, product release news, case studies, we may ask you to provide personal information for sign-up. We may use this data to invite you to and keep you informed about N-SIDE events and campaigns, such as conferences, training sessions, customer panels, and webinars, regarding products similar to those you may have previously engaged with. We may also send you satisfaction surveys to help improve our offerings and services.
Name, company details, e-mail address, phone number, job title, function, information about the sector you work in, reports of our contacts with you, etc.The legal basis is N-SIDE’s legitimate interest in conducting business-to-business marketing and fostering our relationship with you, as permitted under Article 6(1)(f) of the GDPR.
Recruitment process – Personal data you voluntarily provide us through job applications. N-SIDE will only collect and process your personal data to the extent necessary for the purposes of recruitment and selection. The personal data processed are related to the position to be filled and are limited to the data necessary to verify to what extent your motivation, knowledge, skills, competences and experience correspond to the profile of the position for which you are applying or have the required qualities.Identification data such as your name, postal and/or e-mail address, date of birth, age and sex (and any additional information you provide us with);
education and training data: professional information: current position and responsibilities, previous positions and work experience, information about the sector you work in, date of departure, reason for departure, working conditions and gross salary, salary expectations, professional skills and abilities;
data relating to mobility  ; reports of our contacts with you such as notes about your interview(s), email exchanges.
Depending on the individual cases, your personal data is processed on the basis of your request to take steps prior to entering into a contract and N-SIDE’s legitimate interests to address appropriately such steps or your unambiguous consent, directly or through our recruitment service providers. When the basis of the processing is your consent, you have the possibility to withdraw such consent at any time following the procedure communicated, or by contacting us.
Visit of our premises
Personal data you may provide us when visiting our premises (through visitor registration, access control logs). We may collect and process your personal data to ensure security, manage visitor access, and comply with internal safety procedures and legal obligations.

Automatic collection of information from your device when navigating on our website – To better understand the visitors who come to our Website, where they come from, and what content on our Website is of interest to them.  We use this information for our internal analytics purposes and to improve the quality and relevance of our Website to our visitors.Information like your IP address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location) and other technical information.  We may also collect information about how your device has interacted with our Website, including the pages accessed and links clicked.Some of this information may be collected using cookies as explained further in our Cookie Notice.

2. From time to time, we may receive Personal Data about you from third party sources (including event and conference organizers), but only where we have checked that these third parties either have your consent or are otherwise legally permitted or required to disclose your Personal Data to us. The types of Personal Data we collect from third parties include your first name, last name email address, company, title, telephone number. We use this Personal Data we receive from these third parties to maintain and improve the accuracy of the records we hold about you.

3. In general, we will use the Personal Data we collect from you only for the purposes described in this Notice or for purposes that we explain to you at the time we collect your Personal Data.  However, we may also use your Personal Data for other purposes that are not incompatible with the purposes we have disclosed to you (such as archiving purposes) if and where this is permitted by applicable data protection laws.

4. Who does N-SIDE share your Personal Data with?

  1. We may disclose your Personal Data to the following categories of recipients:
    1. to our group companies for purposes consistent with this Notice. We take precautions to allow access to Personal Data only to those staff members who have a legitimate business need for access and with a contractual prohibition of using the Personal Data for any other purpose.
    2. to our third party vendors, services providers and partners who provide services to us, or who otherwise process Personal Data for purposes that are described in this Notice or notified to you when we collect your Personal Data. This may include storage services, IT platform management or support services, infrastructure and application services, marketing, data analytics. When doing so, we always ensure that your information is handled confidentially and in a safe manner and where required, we also always set up a formal agreement with the third-party subprocessors that is intended to protect your data. This way, the subprocessor will never be allowed to use your data on his own initiative and your personal data has to be deleted or returned as soon as the processor has finished the assignment;
    3. to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;
    4. to our auditors, advisors, legal representatives and similar agents in connection with the advisory services they provide to us for legitimate business purposes and under contractual prohibition of using the Personal Data for any other purpose;
    5. to a potential buyer (and its agents and advisers) in connection with any proposed purchase, merger or acquisition of any part of our business, provided that we inform the buyer it must use your Personal Data only for the purposes disclosed in this Notice;
    6. to any other person if you have provided your prior consent to the disclosure.

5. How do we protect your privacy ? 

  1.  We will process Personal Data in accordance with this Notice, as follows
    1. Lawfulness, fairness & transparency: We will process Personal Data fairly and on lawful grounds. This means that we are transparent about how we process Personal Data and that we will process it in accordance with applicable law.
    2. Purpose limitation: We will process Personal Data for specified and lawful purposes, and will not process it in a manner that is incompatible with those purposes.
    3. Data minimization: We will process Personal Data that is adequate, relevant and limited to what is necessary to achieve the purposes for which the data are processed and we will collect the minimum Personal Data required for the intended purpose.
    4. Data accuracy: We take appropriate measures to ensure that the Personal Data that we hold about you is accurate, complete and, where necessary, kept up to date. However, it is also your responsibility to ensure that your Personal Data is kept as accurate, complete and current as possible by informing N-SIDE N-SIDE promptly of any changes or errors that you cannot update or correct yourself directly.
    5. Data security: We use appropriate technical and organisational measures to protect the Personal Data that we collect and process about you.  The measures we use are designed to provide a level of security appropriate to the risk of processing your Personal Data.  Examples of specific measures we use include access control, password with limited lifespan, internal policy with regard to data export, encrypting your Personal Data in transit and at rest, data availability controls, change control procedures, single-sign on, multi-factor authentication.

6. Data retention and deletion

  1. We retain Personal Data we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).
  2. When we have no ongoing legitimate business need to process your Personal Data, we will either delete or anonymise it or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible.

7. International transfers of data

N-SIDE may transfer your personal data to third parties in third countries (outside the European Economic Area (EEA)). The said transfer of data outside the EEA is legal if the recipient of the data resides in a country with a level of protection deemed adequate by the European Commission. Some of these countries may not have enacted equivalent data protection legislation to protect the use of your personal data. In such cases, we have researched whether appropriate preventive measures similar to those implemented within the EU are possible, for example by adopting standard contractual clauses. In specific cases, we will request your prior consent to the transfer of your personal data outside the EEA. 8. What are your data protection rights?

  1. You have the following data protection rights:
    1. access, correct, update or request deletion of your Personal Data. You are entitled to request that we amend, add to or delete any outdated, incorrect or incomplete personal data relating to you when your personal details change. You are also entitled to receive the personal data you have provided to the data controller in a structured, commonly used, machine-readable format, and to transmit it to another data controller.
    2. In certain circumstances, as stipulated in the applicable data protection legislation, you can object to processing of your Personal Data, ask us to restrict processing of your Personal Data or request portability of your Personal Data. Please however be informed that the access to certain services or functionalities will not be possible without the processing of your Personal Data;
    3. If the process is based on your consent, then you can withdraw your consent at any time.  Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Data conducted in reliance on lawful processing grounds other than consent.
    4. You have the right to opt-out of marketing communications we send you at any time.  You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you.  To opt-out of other forms of marketing (such as postal marketing or telemarketing), you may contact us using the details provided below.
    5. If you have a complaint or concern about how we are processing your Personal Data then we will endeavour to address such concern(s). If you feel we have not sufficiently addressed your complaint or concern, you have the right to complain to a data protection authority about our collection and use of your Personal Data.  For more information, please contact your local data protection authority.     6. You are entitled not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning yourself or similarly significantly affects yourself, such as the evaluation of personal aspects related to performance at work, reliability, creditworthiness, etc. The said right not to be subjected to such automated decision-making processes does not apply where the process is allowed on the basis of a mandatory legal provision.  You are not entitled to invoke this right when the decision is required to enter into, or to execute, an agreement between yourself  and N-SIDE or is based on your explicit consent. In the latter two cases, you are entitled to human intervention by a member of the N-SIDE and are entitled to notify us of your position to contest the automated decision.
  2. Exercising your data protection rights: If you wish to exercise any of these rights, please contact us directly through [email protected]. We can request you verify your identity to ensure your request is lawful and that we are sending the reply to a person entitled to make such a request and to receive the data.
    Please note that we may refuse access to your personal data or may not be able to grant your request under specific circumstances when we are entitled to do so under the applicable data protection legislation.

9. Data security measures

N-SIDE makes every effort to guarantee the security of your data. We have implemented reasonable technical and organisational measures to guarantee your personal data against accidental or unlawful destruction, loss, modification, unauthorised disclosure and/or unauthorised access to the data transmitted, saved or otherwise processed. Please note that the internet is an open network; we cannot therefore guarantee that unauthorised third parties will not be able to circumvent these measures or use your personal data for inappropriate purposes.

10. Linking to other websites

The Website may contain hyperlinks to websites owned and operated by third parties.  These websites have their own privacy policies and we urge you to review them. They will govern the use of Personal Data you submit whilst visiting these websites.  We do not accept any responsibility or liability for the privacy practices of such third party websites and your use of such websites is at your own risk.

11. Terms of use of the website and liability 

  1. Rights to the website and materials – Permitted usage:  Our website and the materials available thereon (for example texts, images, videos, data, software, brands and trademarks and other data) are protected by intellectual property rights and other rights vested in us. Visitors to the website are permitted to consult the website and the material for their own purposes. This right of use is non-exclusive and non-transferable and we reserve the right to revoke this right at any time and without justification. Any other use of any element of the website (i.e. reproduction, changes, publication or any other form of distribution) is prohibited, unless we and/or the licensors have provided advance express permission in writing.
  2. Prohibited use of the website and material: You undertake as follows: not to use the website, and the material (1) illegally and/or for illegal purposes; (2) not to damage, modify, interrupt, stop it or impair its efficiency; (3) to disseminate or install computer viruses nor to disseminate or install material that is insulting, obscene, threatening or otherwise not in accordance with the intended use of the website; (4) not to infringe third-party or our rights to privacy, protection of personal data or intellectual property; (5) to disseminate or install material for marketing or advertising purposes without requesting our prior approval and only insofar as the recipient has requested the said material.

Liability: We shall make every effort to ensure the information we add to our website is as complete, correct and current as possible, although we cannot guarantee that the information provided does not include any errors. The information contained therein is not aimed at specific people or organisations and may therefore not be complete, relevant or accurate. We waive all liability for any damage caused by any errors on this website. We make every reasonable effort to limit technical malfunctions. We reserve the right to adjust and review this policy when it is deemed necessary and to remain coherent with the legal obligations and/or recommendations of the competent supervisory authority for data protection. We may also amend or update this Notice to inform you on how we process your personal data at that time. When we update our Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make. You can determine when this Notice was last revised by referring to the “update ” legend at the bottom of this page. Any changes will become effective on our posting of the revised Notice on the website.
